1. Agreement to Terms

By accessing and using this website and platform, you accept and agree to be bound by and comply with these Terms of Service and our Privacy Policy. If you do not agree to abide by the above, please do not use this service.

2. Subscription License

Subject to your acceptance of these Terms and payment of applicable fees, InvestorFunnel grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your internal business purposes during your active subscription period. This license does not include the right to:

• Sublicense, resell, or make the platform available to third parties except as expressly permitted under a white-label agreement with InvestorFunnel
• Modify, copy, adapt, reverse engineer, decompile, or disassemble any portion of the platform or its underlying software
• Remove or alter any proprietary notices, labels, or marks on the platform
• Use the platform to build a competing product or service
• Scrape, crawl, or extract data from the platform by automated means outside of authorized API access
• Transfer or assign your license or account to another party without prior written consent

All rights not expressly granted here are reserved by InvestorFunnel.

3. Disclaimer

The materials on InvestorFunnel's website are provided on an 'as is' basis. InvestorFunnel makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

In no event shall InvestorFunnel or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on InvestorFunnel's website, even if InvestorFunnel or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on InvestorFunnel's website could include technical, typographical, or photographic errors. InvestorFunnel does not warrant that any of the materials on its website are accurate, complete, or current. InvestorFunnel may make changes to the materials contained on its website at any time without notice.

Resource and System Limits

Each subscription plan includes defined resource limits (lead counts, user seats, funnels, and properties) as described on our pricing page. You agree to use the platform within the limits of your selected plan. Specifically, you may not:

• Use automated scripts, bots, or bulk import tools to submit leads in volumes that exceed your plan limits or that degrade platform performance for other users
• Attempt to circumvent plan limits through multiple accounts, account sharing, or any other means
• Ingest, upload, or import contact or lead data at a rate that constitutes abuse of shared infrastructure (we reserve the right to throttle or block requests that exceed reasonable usage patterns)

We reserve the right to suspend or terminate accounts that engage in resource abuse, even if usage falls within stated plan limits, if that usage materially impacts platform availability for other customers. You will be notified before any enforcement action where circumstances allow.

9. Investment Disclaimers

InvestorFunnel is a platform for lead generation and management. We are not a licensed investment advisor or broker. The information provided:

• Is for informational purposes only
• Should not be considered investment advice
• Does not constitute a recommendation to buy or sell
• Requires independent verification before making decisions

Always consult with licensed professionals (real estate agents, attorneys, accountants) before making any real estate transactions.

10. Real Estate Regulatory Compliance

InvestorFunnel provides lead generation, CRM, and marketing tools for real estate investors and operators. You are solely responsible for ensuring that your use of the platform complies with all applicable federal, state, and local laws and regulations governing real estate activity, including but not limited to:

• The Fair Housing Act and applicable state fair housing laws — including prohibitions on discriminatory advertising, targeting, or lead filtering based on race, color, national origin, religion, sex, familial status, disability, or any other protected class
• The Real Estate Settlement Procedures Act (RESPA)
• The Telephone Consumer Protection Act (TCPA) and applicable telemarketing regulations when using SMS or dialer features
• State-specific real estate licensing and disclosure requirements
• CAN-SPAM Act and applicable email marketing regulations

InvestorFunnel does not review, monitor, or pre-approve your marketing campaigns, outreach sequences, lead targeting criteria, or property listings for regulatory compliance. The platform provides tools — you are responsible for how you use them. If you are uncertain whether a specific use is compliant with applicable law, consult a licensed real estate attorney in your jurisdiction before proceeding.

11. Lead Data Ownership

All leads and lead data collected through our platform are your property. InvestorFunnel may use aggregated, anonymized data for analytics and platform improvement, but will not sell individual lead information to third parties without explicit consent.

12. Payment Terms

If you purchase premium services:

• Payment must be made through Stripe, PayPal, or other authorized payment methods
• Subscriptions renew automatically unless canceled
• Refunds are subject to our refund policy
• You authorize us to charge your payment method

13. Limitation of Liability

To the fullest extent permitted by law, InvestorFunnel shall not be liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

In no event shall InvestorFunnel's total cumulative liability to you for any claims arising out of or related to these Terms or your use of the platform exceed the greater of (a) the total fees paid by you to InvestorFunnel in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred dollars ($100). This limitation applies regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise.

14. Indemnification

You agree to indemnify, defend, and hold harmless InvestorFunnel and its officers, directors, employees, and agents from any claims, damages, or costs arising from:

• Your use of the platform
• Your violation of these terms
• Your violation of applicable laws
• Your content or submissions
• Your real estate transactions

15. Third-Party Links

InvestorFunnel may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is governed by their terms and privacy policies.

16. Modifications to Terms

InvestorFunnel may revise these Terms of Service at any time without notice. By using this website, you are agreeing to be bound by the then-current version of these Terms of Service.

17. Termination of Service

InvestorFunnel reserves the right to terminate or suspend your account and access to the platform at any time, for any reason, without notice or liability, including but not limited to:

• Violation of these terms
• Fraudulent or illegal activity
• Non-payment of fees
• Abuse of platform resources

18. Data Retention and Deletion

Suspension vs. Cancellation

Suspended accounts (due to payment failure or policy violation) remain in a frozen state — data is preserved and access is restricted until the issue is resolved or the account is formally canceled. Suspension alone does not start the data deletion clock.

Canceled accounts (voluntary cancellation or termination by InvestorFunnel for cause) trigger the retention window described below.

60-Day Retention Window

Following cancellation, all account data — including leads, deals, properties, funnel configurations, and settings — is retained for 60 days from the cancellation date. During this window:

• Your data remains intact and can be restored immediately if you reactivate your subscription
• You may export all your data at any time via the self-service export tool in your admin panel (Settings → Export Data), or by contacting support
• Platform access is suspended; data is not accessible via the application interface

Deletion Notice and Permanent Removal

Seven (7) days before the end of the 60-day retention window, we will send a deletion notice to the email address on file for your account. After the 60-day window expires, all account data will be permanently and irreversibly deleted from our systems. This action cannot be undone.

Accounts Terminated for Cause

Accounts terminated by InvestorFunnel for violation of these Terms (fraud, abuse, non-payment after extended suspension) may be subject to immediate data deletion without the standard 60-day retention window. In such cases, we will make reasonable efforts to allow data export where legally permissible.

19. Governing Law

These Terms of Service and your use of InvestorFunnel are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Ohio for any disputes arising out of or relating to these Terms or your use of the platform.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and InvestorFunnel regarding the use of the website and services.
